CONSENT AND RELEASE AGREEMENT 1. Parties to the Agreement This Agreement (hereinafter referred to as the "Agreement") is made between [inoice.pro], hereinafter referred to as the "Photographer," and the undersigned, hereinafter referred to as the "Model." By completing and submitting this form, you acknowledge that you are the individual who is legally bound by all terms and conditions of this Agreement. 2. Purpose The Photographer and the Model agree to the creation and use of photographs, videos, and other digital products (hereinafter referred to as "Materials") in the context of a photo shoot/video shoot conducted on [Insert Date of Shoot]. 3. Rights to Materials
All exclusive rights to the Materials created during the photo shoot/video shoot belong solely to the Photographer. This includes, but is not limited to, rights to reproduction, distribution, public display, modification, and creation of derivative works.
The Photographer has the right to use the Materials for any purpose, including but not limited to advertising, marketing, publication in print and electronic media, social networks, and other platforms.
The Model acknowledges that she is not entitled to any compensation or remuneration for the use of the Materials and waives any claims for payment or remuneration that may arise in the future.
4. Model's Rights and Obligations
The Model grants the Photographer an unlimited, royalty-free, irrevocable, and transferable right to use the Materials in any form and for any purpose.
The Model agrees not to make any claims against the Photographer or third parties regarding the use of the Materials.
5. Confidentiality.The parties agree to maintain the confidentiality of the terms of this Agreement and not to disclose them to third parties without the prior written consent of the other party. Exceptions are made for cases where the Materials are published on the internet with the consent of both parties. In such cases, the Photographer and the Model may include links to the published materials on social networks and other public platforms.6. Waiver of Claims.The Model waives any and all claims, including but not limited to claims regarding copyrights, personal rights, or any other rights related to the use of the Materials.7. Consent to Photography.The Model acknowledges and accepts that the photographs and videos created during the photo shoot/video shoot may contain elements of sexual content and imply sexuality, but will be executed within the framework of artistic expression. The Model agrees to participate in the photo shoot/video shoot in this format and confirms that her participation is voluntary and not coerced.The Model also declares that she will not make any claims, including legal actions, regarding the nature of the images or videos, which may contain sexual undertones. All actions of the Photographer within the framework of this Agreement are recognized as lawful and consistent with artistic purposes.8. Governing Law and Dispute Resolution.This Agreement shall be governed by the laws of [your country/region]. Any disputes arising in connection with this Agreement shall be resolved in the courts of [U.S./Florida].9. Legal Costs and Penalties.In the event that the Model or any other party representing the Model files a lawsuit related to any matter arising from projects conducted under the interaction between the Photographer and the Model, including current and future photo shoots, the Model agrees to prepay 100% of the costs for the attorney required to defend the Photographer's interests in the legal proceedings.If the Model or third party fails to meet this obligation, penalties will be incurred at a rate of 3% of the total amount owed for each day of delay. 10. Miscellaneous. 1.This Agreement shall become effective upon the date of submission of this form by the Model.2.Any amendments or additions to this Agreement must be made in writing and signed by both parties.
